Employee Classification

Contractor or employee, exempt or not. Get it right.

Misclassification is one of the most expensive ordinary compliance failures there is. Treat an employee as a contractor and you’re looking at back payroll tax, penalties and benefit liability. Treat a non-exempt employee as exempt and you’re looking at unpaid overtime going back years, usually across a whole job category at once.
